Terms of service

Welcome to EchoVibe. In these terms, “we” and “us” means EchoVibe, and “you” or “the customer” means the person who visits or buys from this store. EchoVibe runs this online store, including all the information, content, features, tools, products and services it offers (the “Services”).

By visiting, using or buying from this store you accept these Terms of Service and our Privacy Policy. If you do not agree with them, do not use the Services. Read them carefully: they include important information about your rights, about the limits of our liability and about how claims are resolved.

1. Access and account

By accepting these Terms you confirm that you are of legal age in your place of residence. To use the Services we may ask you for details such as your email address and your billing and shipping addresses. You undertake that this information is correct, current and complete. You are responsible for keeping your credentials secure and for all activity on your account. You may not assign, sell or transfer your account to anyone else.

2. Our products

We do everything we can to describe and photograph products accurately. Even so, colours and appearance may differ from what you see on your screen, depending on your device and its settings. Product photographs may come from the manufacturer or the supplier and are illustrative.

Descriptions and availability may change at any time without notice. We may stop selling a product or limit the quantities available per person or per geographic area.

3. Orders

When you place an order you are making an offer to buy. EchoVibe may accept or decline it. The order is not considered accepted until we confirm it to you and we have received payment. Check your order carefully before submitting it, because afterwards we may not be able to change it. If we do not accept, or we change or cancel an order, we will try to tell you by the email address or phone number you gave us.

Returns and refunds are governed exclusively by our Refund Policy.

You confirm that your purchases are for personal or household use, and not for commercial resale or export.

4. Prices, payment and taxes

Prices, discounts and promotions may change without notice. The price that applies is the one in force at the moment the order is accepted. Taxes and shipping costs are calculated and shown at checkout before you confirm the purchase.

If we spot an obvious error in a price or a description, we may cancel the order and refund you in full, even if we had already charged you. We will let you know if that happens.

Payment is processed through Shopify's gateways over an encrypted connection. EchoVibe does not store your full card details.

5. Shipping and delivery

Shipping conditions, times and costs are set out in our Shipping Policy. The times we state are good-faith estimates, not contractual guarantees of a delivery date.

6. Permitted use of the Services

You may not use the Services for any unlawful purpose, nor to ask other people to commit unlawful acts, nor to breach regulations or intellectual property rights. Nor may you use them to harass, insult or discriminate; to send false information; to upload viruses or malicious code; to collect other people's data; to send spam; or to interfere with the security of the Services. We may suspend your access if you breach this section.

7. Third-party content and links

The Services may include links to, or content from, third parties that we do not control. We are not responsible for their accuracy or their quality. If you visit a third-party site, its own terms and policies will apply. Review those terms before giving them any data.

8. Comments and suggestions

If you send us ideas, comments or suggestions, we may use them with no obligation of confidentiality, payment or attribution. We are not obliged to keep, answer or publish the content you send us, and we may remove anything we consider offensive, unlawful or contrary to these Terms.

9. Warranties and limitation of liability

The Services are offered “as is” and “as available”. We do not guarantee that the site will always work without interruptions or errors, nor that the results of using it will meet your expectations. Nothing stated here excludes or limits the statutory warranties that the consumer regulations of your place of residence grant you on a mandatory basis.

To the extent permitted by law, EchoVibe will not be liable for indirect, incidental, special or consequential damages arising from the use of the Services. Our total liability towards you, on any grounds, will not exceed the amount you paid on the order giving rise to the claim.

10. Indemnity

You undertake to hold EchoVibe harmless against third-party claims arising from your breach of these Terms or of the applicable regulations.

11. Force majeure

We will not be liable for delays or failures caused by events beyond our reasonable control: natural disasters, severe weather, strikes, utility outages, carrier failures, conflicts, administrative restrictions or health emergencies.

12. Term and termination

These Terms are effective for as long as you use the Services. You can stop using them whenever you want. We may suspend or cancel your access if you breach any of their provisions. Obligations already incurred before termination remain enforceable.

13. Severability and waiver

If any point of these Terms is declared invalid or unenforceable, it will still apply to the extent the law allows and the rest will remain fully in force. The fact that we do not enforce a point at a given moment does not mean we waive the right to do so later.

14. Entire agreement

These Terms, together with the policies linked in this store, form the entire agreement between you and EchoVibe about the use of the Services, and replace any earlier agreement.

15. Governing law

These Terms are governed by the laws of the State of Washington and the federal laws of the United States, without application of their conflict-of-law rules. This is without prejudice to the mandatory rights that the consumer regulations of your place of residence grant you.

16. Changes to these Terms

We may update these Terms to reflect changes in our practices or for legal or operational reasons. The version in force is always the one published on this page, with its update date. If you keep using the Services after a change, you will be taken to accept it.
